On September 12, 2022, Marine Corps judge Lieutenant Colonel E.A. Catto disregarded evidence of Unlawful Command Influence and denied GySgt Draher and Negron’s defense motion to dismiss their charges. This decision occurred despite the government’s own admission that Colonel Shaw’s comments were highly disturbing.
After waiting for well over three years, and after numerous motion hearings, it appears that their trial will now move forward on January 17, 2023 at MCAS Cherry Point.
Chief Eric Gilmet’s defense team is awaiting a decision on their appeal to United States Court of Appeals for the Armed Forces (CAAF) after the Navy-Marine Corps Court of Criminal Appeals (NMCCA) overturned the trial judge’s original dismissal of Gilmet’s case and reinstated all charges that had previously been dismissed with prejudice on February 9, 2022.

The so-called MARSOC 3 cases involving GySgt Draher, GySgt Negron, and Chief Petty Officer Eric Gilmet involve allegations, each stemming from an incident that took place in Erbil, Kurdistan (Northern Iraq) on New Year’s Eve, 2018 in which the Marine Raiders were assaulted by an American civilian contractor.
Despite the overwhelming evidence of the MARSOC 3 acting in self-defense and the defense of others, they were charged with involuntary manslaughter, negligent homicide, obstructing justice, and violations of orders.
